Per court documents, Witherspoon cited "irreconcilable differences" as the reason for their divorce. She filed the proceedings on April 1, 2023.

The exes settled their divorce four months after Witherspoon first filed. They reportedly signed a dissolution agreement and signed off a parental plan for their son, who is ten. Witherspoon, who once called Toth an "amazing hubby" in a birthday post honoring him in July 2020, listed the filing date as the date of their separation and revealed they have a prenuptial agreement.

The doting mom asked the court for joint custody of their son, Tennessee James. The two announced their official split in an Instagram post on March 24, 2023, writing, "[...] It is with a great deal of care and consideration that we have made the difficult decision to divorce."

Witherspoon and the talent agent, whom she once said she was "lucky" to have in her life, further stated they would focus on co-parenting their son, as well as her two kids from her previous marriage.

An insider revealed this was a mutual decision from both parties, who remain "best of friends" despite the circumstances and aim to make the process less painful for their loved ones.

Another source disclosed that the mother of three was strong-willed and attentive, while Toth was more "laid-back" in their relationship. And due to being busy with work, the pair reportedly did not spend much time together.

Toth and Witherspoon wed in March 2011 at her ranch in Ojai, California. The lovebirds were first rumored to be dating in February 2010 after being spotted having dinner together in Santa Monica. They got engaged in December of that year.

Following their nuptials, the two welcomed their only child, Tennessee, a year later, in September 2012. In addition to Tennessee, Witherspoon is a mom to daughter Ava and son Deacon, whom she welcomed with her former husband, actor Ryan Phillippe.

Witherspoon and the father of two wed in June 1999 in South Carolina, less than a year after he proposed. They had their eldest child, Ava, in September 1999, three months after getting hitched. Their son Deacon followed four years later in October 2003.

Phillippe and Witherspoon were once Hollywood's most beloved couple until they split in 2006 following seven years of marriage. But they have been co-parenting their brood over the years and have remained friends.

There were rumors that they split because of infidelity on his part, but that was never confirmed. Moreover, there seemed to be trouble in paradise four years earlier when they announced the nominees for best make-up at the 2002 Oscar Awards.

The "Big Little Lies" star jokingly asked her then-husband if she could open the envelope to announce the winner, and he suggested she should do the honors since she earned more money than he did. The BAFTA Award winner later expressed she was bewildered by his unscripted comment.

Although Phillippe was also famous during that period, the producer was more popular, but he said he was okay with that. The "Crash" star noted how other people tried to make them butt heads constantly, and whenever he and Witherspoon went through some hard times, they would paint him out to be the bad guy, stating that it was because he envied her.

The Delaware native said there was no such thing because he supported women. He has sisters and was raised by the women in his family, so he could never feel jealous of Witherspoon's success, even though other people tried to make it seem that way.

What Led to Witherspoon & Toth's Divorce?

Aside from the speculations regarding the demise of her first marriage, insiders have since shared possible reasons why Witherspoon's second marriage also failed.

Shortly after announcing she and Toth were parting ways, a source revealed nothing scandalous or dramatic occurred behind closed doors leading the pair to split.

The insider explained Toth and "The Morning Show" star fell out of love and became co-parents within their marriage as it fizzled out. Meanwhile, another source said the separation had long been foreseeable.

Still, more insiders have come up with multiple reasons why the Academy Award winner and the Pennsylvania native are getting a divorce. They alleged the duo's relationship was in trouble after Toth left his position at the talent and sports agency CAA to join Quibi. This mobile streaming service became short-lived only six months after going live in 2020.

One source claimed Toth's decision to leave his job to join the tech company was a huge risk. Witherspoon had reportedly asked him if he was sure about his choice, and he expressed confidence that he was going to make more money. This suggests that things between the two went downhill from that point.

Another insider, who claimed to be a family friend of the pair, alleged that Toth's decision to leave his former job was a result of having a "mid-life crisis" that ultimately led to the dissolution of his marriage. "Jim is the one who changed massively just in the last few years," the insider claimed.

The source also referenced Witherspoon's Hello Sunshine production company sale and claimed it made the circumstances even more unfavorable. The "Just Like Heaven" star became the wealthiest woman in showbiz after selling it for a whopping $900 million in 2021.

Toth, a founding board member at the said company, showed his then-wife massive support throughout the deal. However, the money they made from the sale eventually made them drift apart.

The insider purported that the millions of dollars earned gave the now-divorced duo a reality check because they now had more money in the bank and did not know what to do with it.

In addition, Witherspoon and Toth allegedly had long wanted to live separate lives. But be that as it may, she is said to be devastated about the split because she never thought she would get divorced again.

Where Is Witherspoon Living After the Divorce?

It has already been established how Witherspoon and Toth will move forward as co-parents, keeping the kids as their main priority. An insider once revealed that the two are devoted to ensuring that co-parenting works out for them.

Aside from her illustrious acting career and lucrative business deals, being a mom is the most important for Witherspoon. While balancing everything has been difficult, she said her sacrifices were worthwhile.

While she and Toth will now focus on co-parenting, it seems they have already sorted out their assets. It turns out the two had quietly divided their assets over the years before announcing their split. According to an insider, Witherspoon had been getting her finances in order since late 2020, and she and Toth had already been liquidating their joint properties and companies for over two years.

Previously, Witherspoon owned three estates: a mansion in Pacific Palisades, a country estate in Ojai, and a bucolic farm in the Malibu foothills, but she has since sold them all.

In 2022, the award-winning star moved out of her sprawling Brentwood home and sold it for $21.5 million after buying it for 16 million two years prior. The house was 10,343 square feet, and judging from the before and after photos, she remodeled it.

Witherspoon repainted it with a brighter trim both on the interior and the exterior. The home now has marble floors in the entryway, new white oak hardwood on the stairs, and the living room boasts new wrought iron railings.

The library was painted blue, and the chef's kitchen was redone. The estate sits on over three acres of land in the Mandeville Canyon area and is hidden behind large, secure gates. The English-style abode features a circular motor court out front. It also has a separate service entry and driveway, which is also gated. The mansion boasts seven bedrooms and nine bathrooms.

According to the listing, all bedrooms are ensuite, including the two guest quarters on the main level. The bedrooms are upstairs, and the primary bedroom is in its owner's wing. It features high vaulted ceilings and a huge sitting area.

The space features wooden floors and white paint with matching furnishings. It also has dual bathrooms, which are white with marble on the side of the wall and countertops.

The mansion was built in 1993 and boasted a double-height open entry hall with checkerboard marble floors and an elegant staircase that leads up to a spacious landing.

The living room includes a fireplace, the library, which was once wood-paneled, a formal dining room with a large wooden table, and beige chairs with a matching carpet.

There is a breakfast room off of the kitchen with beamed ceilings. The kitchen features stone counters, white cabinets, an island, and designer appliances, including a silver double-door refrigerator.

The exterior features rolling lawns, mature trees, gardens, and a limestone bar area. There is also a saltwater swimming pool, a spa, an outdoor kitchen, and a large outdoor fireplace.

In adding to her real estate portfolio, records revealed Witherspoon spent almost $28 million in the first quarter of 2022, acquiring four new houses. However, the deals got sealed off the market, meaning photos of them are almost nonexistent.

She purchased a modest ranch house for $5 million in Los Angeles, also located in the Brentwood neighborhood and close to the Mandeville Canyon home she previously sold.

The property boasts four bedrooms and three bathrooms with 2,600 square feet of living space on a single level. It wraps around a concrete patio and a dark-bottom swimming pool. The abode has a long private driveway and was built in 1959.

Witherspoon bought three more houses in Nashville, where she and her family live part-time. The primary residence she once shared with Toth and the kids was a mansion in an exclusive part of the city. Again, the interior of the home has yet to be shown.

The pair paid $18 million for an estate in the prime pocket of town on a property that sits on four acres. The house was custom-built in 2020 by the sellers, B. Michael Shivers, a subprime auto loan kingpin, and his wife, Margaret.

The duo's home is located in a gated community. The primary residence consists of a 15,000-square-foot detached full house, a separate pool house, a spoon-shaped swimming pool, a full-size tennis court with a viewing pavilion, and an expansive lawn terrace.

Although it remains unclear how the inside of the abode looks, Witherspoon is known to opt for traditional-style houses with chic and modern décor.

Massive trees surround the leafy estate, which is situated near parks, shopping centers, and dining establishments. The previous owners paid $2.7 million for the land in 2017 and later demolished the smaller home there.

Another property Witherspoon bought in Nashville is a historic building downtown full of commercial properties. She purchased an 1879-built brick red home for $4.2 million and later renovated it.

The estate has 3,000 square feet front house with a kitchen and a second building at the back. It spans 1,300 square feet of space.

The third house Witherspoon purchased was $672,000, situated in Franklin, Tennessee, a quiet suburb in Nashville. It boasts 2,200 square feet of space and features three bedrooms and two bathrooms.

The exterior brick of the residence was freshly painted, and the abode backs onto a golf course. Reports suggest it may be one of her investments.

In addition, the Emmy Award winner already owns several homes in Nashville – some reportedly occupied by family members. Aside from two smaller homes in the area, one abode spans 8,400 square feet.

Years ago, Witherspoon sold another home in Malibu, which served as her vacation getaway. It was sold in an off-market deal for only $6.7 million. It sits on two acres of land and features multiple structures.

The house was initially built in 1950 as a modest mid-century property. It was later modernized and remodeled by a couple who used it as a wedding venue before the Golden Globe Award winner moved in. It had open-plan living areas with Boho chic style and three vintage-inspired bedrooms and bathrooms.
